1. Acceptance of Terms
Welcome to Restore Services Kenya. By accessing our website, requesting services, or engaging with our company, you agree to be bound by these Terms of Service ("Terms"). If you do not agree with any part of these terms, please do not use our services.
These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and Restore Services Kenya ("Company," "we," "us," or "our").
2. Services Description
Restore Services Kenya provides professional water tank repair, maintenance, cleaning, and installation services, including but not limited to:
- Plastic water tank repair using hot air welding techniques
- HDPE and LDPE tank restoration
- Emergency 24/7 tank leak repair
- Water tank cleaning and sanitization
- Tank installation and maintenance
- Agricultural, industrial, and residential tank services
- Sale of new water tanks (Kentank products)
3. Service Requests and Bookings
3.1 Booking Process
- Service requests can be made via phone (+254 703 402 611), WhatsApp, email, or our website contact form
- All bookings are subject to availability and confirmation by our team
- We reserve the right to decline service requests at our discretion
3.2 Service Assessment
Upon arrival, our technicians will conduct a professional assessment of your tank. If the damage is more severe than initially reported, we will provide a revised quote before proceeding. You have the right to decline the service without obligation.
4. Pricing and Payment
4.1 Pricing
- Prices quoted are estimates and may vary based on actual damage assessment
- All prices are in Kenyan Shillings (KES)
- Prices include labor, materials, and standard equipment
- Additional costs may apply for emergency services, remote locations, or specialized repairs
4.2 Payment Terms
- Payment is due upon completion of services unless otherwise agreed in writing
- Accepted payment methods: M-Pesa, Bank Transfer, Cash
- A deposit may be required for large projects or custom orders
- Failure to pay may result in suspension of warranty coverage
4.3 Cancellations and Refunds
- Cancellations made 24 hours before scheduled service: Full refund of deposit
- Cancellations made less than 24 hours: 50% cancellation fee applies
- No-shows without notice: Full deposit forfeited
- Emergency call-out fees are non-refundable once technician is dispatched
5. Warranty and Guarantees
5.1 Service Warranty
We provide a 1-Year Warranty on all tank repair work, covering:
- Workmanship defects in welded repairs
- Material failures in replacement parts installed by us
- Leaks at repair points under normal usage conditions
5.2 Warranty Exclusions
The warranty does NOT cover:
- New damage caused by accidents, misuse, or negligence
- Normal wear and tear
- Damage from extreme weather events beyond normal conditions
- Repairs or modifications made by third parties after our service
- Tanks used for non-water storage without prior disclosure
- Damage from overfilling or excessive pressure
5.3 Product Warranty (New Tanks)
New water tanks sold by us carry the manufacturer's warranty (typically 10 years for Kentank products). Warranty claims must be directed to the manufacturer according to their warranty terms.
6. Customer Responsibilities
- Accurate Information: Provide accurate details about tank condition, location, and access
- Site Access: Ensure safe and clear access to the tank repair site
- Water Shutdown: Arrange to empty or reduce water levels before service (unless emergency repair)
- Property Protection: Secure valuables and pets during service
- Payment: Make timely payment according to agreed terms
- Follow-up Care: Follow maintenance recommendations provided by technicians
7. Limitation of Liability
7.1 Service Limitations
While we strive for excellence, we cannot guarantee that all tank damage is repairable. In cases where repair is not feasible, we will recommend alternative solutions including tank replacement.
7.2 Liability Cap
Our total liability for any claim related to our services shall not exceed the amount paid for the specific service in question. We are not liable for indirect, consequential, or incidental damages including but not limited to:
- Water damage to property before or after service
- Loss of business or income due to tank downtime
- Damage caused by pre-existing tank weaknesses not visible during assessment
- Damage from customer misuse after service completion
7.3 Force Majeure
We are not liable for delays or failure to perform due to circumstances beyond our reasonable control, including natural disasters, strikes, government restrictions, or other force majeure events.
8. Intellectual Property
All content on our website, including text, graphics, logos, images, and software, is the property of Restore Services Kenya or its content suppliers and is protected by Kenyan and international copyright laws.
You may not reproduce, distribute, or create derivative works from our website content without express written permission.
9. Privacy and Data Protection
Your privacy is important to us. Our collection, use, and protection of your personal information is governed by our Privacy Policy, which is incorporated into these Terms by reference.
10. Emergency Services
Our 24/7 emergency service is subject to the following conditions:
- Emergency call-out fees apply (non-refundable)
- Response time is estimated; actual arrival may vary due to traffic, weather, or technician availability
- Emergency pricing may be higher than standard service rates
- We prioritize emergencies by severity and safety risk
11. Dispute Resolution
11.1 Complaints Process
If you are dissatisfied with our service:

- Provide detailed description of the issue with photos if applicable
- We will investigate and respond within 5 business days
- If unresolved, we will arrange a site visit to assess the complaint
11.2 Governing Law and Jurisdiction
These Terms are governed by the laws of Kenya. Any disputes shall be resolved through:
- Good faith negotiation between parties
- Mediation (if negotiation fails)
- Arbitration in Nairobi, Kenya under Kenyan Arbitration Act
- Courts of Kenya (as last resort)
12. Modifications to Terms
We reserve the right to modify these Terms at any time. Changes will be effective immediately upon posting on our website. Your continued use of our services after changes constitutes acceptance of the modified Terms. We encourage you to review these Terms periodically.
13. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
